Welcome to Pinomm.com. We are pleased to have you here, but before you start using our website, you must review and accept these terms and conditions. We have tried to explain these terms in an accessible and understandable language for all our users.

These are your legal rights and obligations, so please read everything. If you do not agree with our terms, we will be unable to provide you with our services.

Joining and Using Pinomm.com

This section explains how to subscribe to Pinomm.com and use our services.

You and Pinomm.com: When we say “you” or “your,” we mean both you and any legal entity or company you are authorized to represent. When we say “Pinomm.com,” “we,” “our,” or “us,” we refer to the legal entity “BULSAGO TRADE SOLUTIONS” Ltd., UIC 207726639, with whom you enter into an agreement and pay fees based on the version of the software product on the Pinomm.com page that you use.

Our Services: Our services consist of all services we provide now or in the future, including our online accounting and financial products.

Creating a Subscription: When you create a subscription to use our services and accept these terms, you become a subscriber and agree to pay the corresponding subscription fee.

User Roles and Access: There are three user roles that define the level of access:

  • Administrator: This role allows full access to our services. Typically, this is the user who registers the company and manages the subscription.
  • Accountant: This role allows limited access to our services and is aimed at personnel engaged in processing primary accounting documents, preparing tax and social security obligations, and other financial reports.
  • Employee: This role has the most limited access level to the site and is specifically targeted at personnel engaged in sales and invoicing.

As a subscriber, your default user role is “Administrator.” An Administrator user can invite other users and predefine their role in the team they will participate in.

Right to Use Our Services: Whether you are a subscriber or an invited user, we grant you the right to use our services (based on your subscription type, your user role, and the access level you have received) as long as the subscriber continues to pay for the subscription, until the subscription is terminated, or—if you are an invited user—until your access is revoked.

Role of Subscriber: As a subscriber, you take full control over how your subscription is managed and who has access to it. For example:

  • You control access to the subscription. You decide who is invited to use our services you have subscribed to and what kind of access the invited user has. You can change or revoke this access at any time.
  • You are responsible for resolving any disputes with all invited users regarding access to your subscription.
  • You are responsible for all your invited users.

Rules: Whatever your role, when using Pinomm.com, you agree to follow the rules described on this page. Please read them and ensure you understand their meaning, your rights, and your obligations.

Your Responsibilities: You agree to keep your information (including current email address) up to date. You are responsible for the accuracy, precision, and completeness of the information you provide in connection with your use of our services. You are also responsible for protecting your username and password from theft or misuse. Our service has standard password requirements, but you must ensure that the passwords are very strong and not easily guessable.

When We Introduce New or Revised Services: We strive to make Pinomm.com the best financial software by regularly expanding our services. New or updated services may have additional terms.

What We Own: We own everything we have invested in our services unless otherwise stated, except for content owned by third parties. This includes rights to the design and appearance of our services. It also includes rights to all copyrighted works, trademarks, designs, inventions, and other intellectual property. You agree not to copy, distribute, modify, or create derivative works of any part or all of our content, and not to use any of our intellectual property rights in any way that is not expressly permitted by us.

Pricing

Unless you are on a free trial or another promotional period, you will need to pay for a subscription based on the price of your chosen plan. The pricing details and other terms of your subscription are explained on our homepage and within the product itself when you select your plan and upon expiration of the subscription period, in an explicit notification to you.

Trial Subscriptions

When you first register, you start with a free trial based on the terms stated at the time. If you decide to continue using our services after the trial period, you will be charged when you add your billing information to our services, as detailed in the pricing plan. If you decide not to continue using our services after the trial period, you can delete your subscription.

Pinomm.com Pricing Plans

Using our services generally requires you to pay a monthly or annual subscription fee based on your subscription type (the subscription fee). The pricing plan consists of the subscription fee. The pricing plan includes three subscriptions: “Standard,” “Plus,” and “Premium.” The terms of each pricing plan are described on the homepage of Pinomm.com.

Importance of Timely Payments

To continue using our services, you must make timely payments based on your selected pricing plan. To avoid late or missed payments, please ensure we have accurate payment information. If we do not receive timely payments, we may restrict or suspend access to your subscription until the payment is confirmed.

Data Use and Privacy

Pinomm.com uses your data to provide our services to you. Our Privacy Policy is an important part of these terms and details how we handle personal data, such as your name and email address.

Data Use

When you input or upload your data into our services, we do not own this data, but you grant us the right to use, copy, transmit for legal and contractual purposes, store, analyze, and archive all data you provide through our services, including personal data about you and others, to: enable you to use our services; improve, develop, and protect our services; create new services; communicate with you regarding your subscription.

Anonymous Statistical Data

When you use our services, we may create anonymous statistical data from your data and use of our services, including through aggregation. Once anonymized, we may use it for our own purposes, such as providing and improving our services, developing new services or product offerings, identifying business trends, and other purposes.

Data Breach Notifications

If we believe there has been unauthorized access to personal data in your subscription, we will notify you, provide information about what happened, and advise you on appropriate actions to take.

Confidential Information

We take reasonable precautions to protect your confidential information and expect you to do the same for ours.

Security

To protect our services and your data, we offer additional security features aligned with the best practices in internet security.

Security Guarantees: We have invested in technical, physical, and administrative safeguards to help keep your data safe and secure. While we have taken steps to protect your data, no method of electronic storage is completely secure, and we cannot guarantee absolute security. We may notify you if we have reason to believe that someone has accessed (or may access) your account without authorization, and we may also restrict access to certain parts of our services until you confirm that the access was by an authorized user.

Account Security Features: We may implement security features to make your account more secure, such as multi-factor authentication. Depending on where you are in the world or which services you use, we may require you to accept some of these features. When we make the use of security features optional, you are responsible (meaning we are not liable) for any consequences from not using these features. We recommend that you use all available additional security features.

Your Role in Protecting Your Data: You play an important role by keeping your login credentials secure, not allowing others to use them, and ensuring that you have strong security for your own systems. If you become aware of unauthorized use of your password or a security breach of your account or email address associated with your account, you should notify us immediately.

Support, Technical Issues, and Data Loss

We have taken necessary steps to minimize the loss of access to Pinomm.com, but occasional maintenance is required to keep our services updated and secure. You may also encounter occasional access issues and data loss, so backing up your data is important. In such cases, you will be notified appropriately.

Availability: We strive to maintain the availability of our services 24 hours a day and provide online support during business hours. Sometimes, we need to perform updates on our services, which may require short periods of downtime. We try to minimize any such periods. When planned maintenance occurs, we will notify you in advance, but we cannot guarantee this.

Data Loss: Data loss is an inevitable risk when using any technology. You are responsible for maintaining copies of your data entered into our services.

Modifications: We frequently release new updates, modifications, and improvements to our services, and sometimes we discontinue features. When this happens, we will notify you appropriately.

Limitations: Some of our services may be subject to restrictions, such as a limit on the number of transactions initiated monthly.

Free or Beta Services: Occasionally, we may offer a service for free – for example, a beta service or a time-limited trial account. Due to the nature of these services, you use them at your own risk.

Although we cannot cover everything here, we want to highlight a few more examples of things you should never do:

  • Undermine the security or integrity of our computer systems or networks.
  • Use our services in any way that could impair functionality or interfere with others’ use.
  • Access any system without authorization.
  • Introduce or include anything in our services that contains viruses or other malicious code.
  • Share anything that could be offensive, illegal, or violate others’ rights.
  • Resell, rent, or provide our services in a manner not explicitly permitted by our services.
  • Resell or sublicense any potential customer data or information accessed through our services.
  • Commit fraud or other illegal acts using our services.
  • Act in an offensive or disrespectful manner towards any Pinomm.com employee, partner, or other customer. We will not tolerate abuse or harassment of Pinomm.com employees under any circumstances, including interactions with our support teams.

Termination of Contract

You can easily terminate your subscription online through your administrator profile on the website.

Subscription Period: Your subscription continues for the period covered by the paid subscription fee. At the end of each billing period, these terms automatically renew for an additional period of the same length as the previous one, provided you continue to pay the subscription fee according to the pricing plan. You may choose to terminate your subscription at any time using your administrator profile on the website. You are liable for all applicable subscription fees up to the day of termination.

Termination by Pinomm.com: Pinomm.com may choose to terminate your subscription at any time by providing one month’s prior written notice. Pinomm.com may also terminate or suspend your subscription or access to all or any data immediately if:

  • You breach any of these terms and it is not possible to remedy the breach;
  • You breach any of these terms and do not remedy the breach within 7 days of receiving notice of the breach, where remedying the breach is possible;
  • You have not paid the subscription fees, become insolvent, initiate liquidation proceedings, or a receiver or manager is appointed over any of your assets, as well as in other cases provided by law.

No Refunds: No refunds are due if you terminate your subscription or if Pinomm.com terminates it in accordance with these terms.

Retention of Your Data: Once the subscription is terminated by you or by us, it is archived, and the data sent or created by you is no longer accessible to you. We retain it for a period in accordance with our data retention policy, during which you, as a subscriber, may reactivate your subscription and regain access to your data by paying the subscription fees. We keep data in case you need it as part of your record-keeping obligations, but you may contact us to permanently remove your data if you wish.

Liability and Indemnification

This section is important as it outlines the terms of liability between us and both subscribers and invited users, so we urge you to read it carefully and in full.

You Indemnify Us: You indemnify us against all losses, costs (including legal costs), expenses, claims, or liabilities that we incur arising from or in connection with a third-party claim against us related to the use of our services or a third-party product (except to the extent that we are at fault).

Disclaimer of Warranties: Our services and all third-party products are provided to you on an “as is” basis. We disclaim all warranties, express or implied, including any implied warranties of non-infringement, merchantability, and fitness for a particular purpose.

Limitation of Liability: Except for liability that we cannot exclude or limit by law, our liability to you in connection with our services or these terms, whether in contract, tort (including negligence), or otherwise, is limited as follows:

  • We are not liable for any loss of revenue or profit, loss of reputation, loss of customers, loss of capital, loss of expected savings, legal, tax, or accounting issues, damage to reputation, loss of connection with any other contract, or indirect, consequential, incidental, punitive, exemplary, or special loss, damage, or expense arising from your use of our services.
  • For loss or damage to your data, our liability is limited to taking reasonable steps to attempt to recover such data from our available backups.

Our total liability to you under any circumstances is limited to the total amount you have paid us for your subscription in the 12 months immediately preceding the date on which the claim giving rise to the liability arose.

Disputes

Dispute Resolution: We can assist in resolving any disputes that may arise in connection with your use of our services. To do so, please contact us at [email protected]. If we are unable to satisfy your complaints (or if we fail to resolve a dispute with you after attempting to do so informally), you and we agree to resolve such disputes through the applicable legal provisions in force in the Republic of Bulgaria.

Additional Terms

No Professional Advice: Pinomm.com may provide you with information that we believe may be useful in managing your business, but this should not be considered a substitute for professional advice, and we are not liable for your use of the information in this manner.

Events Beyond Our Control: We are not liable to you for any failure or delay in performing any of our obligations under these terms that arise from any event or circumstance beyond our control.

Notices: Any notice you send to Pinomm.com must be sent to [email protected]. All notices we send to you will be sent to the email address you provided through your subscription.

Export Restrictions: You must not use our services in violation of export laws or trade embargoes applicable to you.

Excluded Terms: The terms of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act (UCITA) do not apply to these terms.

Blocking Your Access, Deactivating Your Subscription, or Refusing Payment Processing: We reserve the right to block your access, terminate your subscription, or refuse to process a payment if there is a risk—such as a potential violation of law or regulation—related to you, your company, your subscription, or payment.

Relationship Between Parties: The relationship between Pinomm.com and you should be treated as a service provider and service recipient relationship. You are solely responsible for resolving disputes between you and any other subscriber or invited user.

Changes to These Terms: Given the dynamic nature and specifics of Pinomm.com’s operations, we periodically update our terms. It is your responsibility to monitor for such changes. Enforcement of Terms: If any of these terms are invalid, this does not render the remaining terms invalid, and only that specific term will be deemed unenforceable.
